Trial is tentatively set for March 2027.
At yesterday’s case management conference, my attorney appeared in person and I attended by Zoom. No defense attorney appeared.
I’m still waiting on the deposition transcript, but I remember this part vividly: Costco’s attorney spent very little time asking about the incident, the documented damages, or the disruption to my family. Instead, he focused heavily on personal and impeachment-style topics — including legal trouble from when I was a teenager roughly 20 years ago, my relationship with my mother-in-law, and he even insinuated that my wife (also a Plaintiff), Dr. Anna Byrd, was a "mail order bride.” Once the transcript is available, I will quote the exchange accurately.
The deposition was noticed to end at 4:00 p.m. When we reached the noticed end time, Costco’s attorney argued that he didn’t get a fair share of time because he failed to coordinate with RXO’s counsel. There was a dispute on the record about extending the deposition. Even so, we continued until approximately 5:05 p.m. as a courtesy.
When the transcript arrives, I will share excerpts consistent with my attorney’s guidance and any applicable court rules.
